These Terms of Service (“Terms”) govern your use of the OpenRemark comment system (“Service”) provided on the Shaped by AI website (“Website”), operated by Stefano Toffolo (“Provider”, “I”, “me”).

By using the comment system, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of Service

The Service allows registered users to leave comments on articles published on the Website.

The Service is self-hosted: it runs on a dedicated OpenRemark instance operated exclusively by Stefano Toffolo at comments.shaped-by-ai.com, deployed on Scaleway cloud infrastructure located in the European Union. Comments are not delegated to a third-party commenting platform, a social network, or an advertising network, and comment data is not processed by any party other than the Provider and the hosting provider acting on the Provider’s instructions.

2. User Accounts

To post comments, you must authenticate via a supported third-party identity provider (Google, GitHub, or Discord). The Provider does not store your password. Only your name, email address, and avatar URL are retrieved from the identity provider and stored locally to associate comments with your profile.

3. Acceptable Use

You agree to:

  • Post respectful and constructive comments relevant to the article
  • Refrain from posting spam, offensive content, hate speech, harassment, or illegal material
  • Not attempt to abuse, exploit, or disrupt the Service

The Provider reserves the right to moderate, edit, or remove any comment that violates these standards, and to suspend or ban users who repeatedly violate them.

4. Content Ownership

You retain ownership of the comments you post. By posting a comment, you grant the Provider a non-exclusive, worldwide, royalty-free license to display, store, and distribute your comment on the Website.

5. Data Privacy

The Provider collects and stores the following data when you use the Service:

  • Your display name, email address, and avatar URL (from the identity provider)
  • The content and timestamp of your comments
  • The IP address at the time of posting (for abuse prevention)

This data is stored on the Provider’s self-hosted instance on Scaleway infrastructure in the European Union, protected by encrypted connections (HTTPS) and access controls. It is not sold, and it is not shared with third parties except as required by law. You may request deletion of your data at any time by contacting [email protected].

Separately from the Service, the Website uses Google Analytics 4, loaded through Google Tag Manager, to measure aggregate traffic. It sets cookies or similar browser storage and collects usage data such as pages viewed, referring site, and approximate geographic location. This data is used only in aggregate and is not used to identify individual visitors; the Website does not run advertising or retargeting.

6. Disclaimer of Warranties

The Service is provided “as is” without any warranty, express or implied. The Provider makes no guarantees regarding the availability, reliability, or security of the Service.

7. Limitation of Liability

To the fullest extent permitted by applicable law, the Provider shall not be liable for any damages arising from your use of or inability to use the Service.

8. Changes to Terms

The Provider reserves the right to update these Terms at any time. Changes will be posted on this page with an updated “Last updated” date. Continued use of the Service after changes constitutes acceptance of the new Terms.

9. Governing Law

These Terms are governed by the laws of Italy.
